Francis Njaramba Mirau, petitions this court for a grant of letters of Administration Ad-litem of the Estate of Mathew Wahome Njaramba, who died domiciled in Ngo’mbe nguu Mairo-Inya Simbara, Kaheho, on 9 th February, 2025, limited for purposes of filing and prosecuting a civil suit arising from a road traffic accident.
The application is supported by a death certificate in respect of the deceased, a letter from the Assistant Chief, Simbara Sub-location, Kaheho confirming the petitioner’s relationship with the deceased. I did cause Annah Murugi Njaramba the deceased mother to appear virtually before the court who confirmed the fact of the deceased’s demise.
I have duly considered the application. Generally, an action regarding the estate of the deceased would be conducted after confirmation of the grant of representation. However, there are instances where there is need for action to be taken by the dependants to preserve the estate, including institution of legal proceedings; and, it is on such an instance that a limited grant can be issued.
It is demonstrated that the deceased was involved in a road traffic accident and the petitioner is desirous of suing on behalf the estate, a specified purpose that is plausible.
In the premises, I am satisfied as to the reasons why the Limited grant of letters Administration Ad-Litem should issue. Consequently, I direct that Letters of Administration Ad-Litem shall issue limited to filing and prosecution of the suit without power of Distribution of the Estate.
It is so ordered.
