' I have perused the summons dated 3rd December 2025, the supporting affidavit of Sospeter Mathi Matheka, sworn on the same date, and the documents annexed thereto. I''m not satisfied that there is urgency in this matter. The grant was confirmed in 2006. The administrators have dragged their feet and failed to conclude the distribution despite the effluction of over 19 years. The applicant, on his part, ought to have acted with dillgence and brought the application much earlier.
In the circumstances, I order that the application be served within three days of the date hereof for an inter partes hearing on 14th January 2026.
