The Objectors herein moved Court vide Summons dated 16 th March 2021 asking that the Petition be struck out for being incompetent and in the alternative Hellen Wanjiru Mbugua be appointed as Co Administrator. On 26 th March 2023, I directed that the Objection proceed to hearing by written submissions.
When I retired to write my ruling neither party had filed submissions as directed. I also note that the Objection is not ripe for hearing as the registrar has not issued notice as required under rule 17 (5) of the Probate and Administration Rules.
For this reason, I direct that the matter be mentioned before the Deputy Registrar on 15 th October 2025 for directions to issue under Rule 17(5) of the Probate and Administration Rules.
