RULING
1. Having heard the parties and considered the application before me, noting that this matter has been in court for a long time, that the subject matter is an asset listed for distribution in the deceased’s estate, and that the claim over the said asset is by one beneficiary. Having weighed the pros and cons in this matter and having partially heard the matter, it is only just and fair that I stay the proceedings pending the hearing and determination of the suit filed in the ELC over Land Parcel Kakamega/Lukuyani/NO. 131.
2. This matter will be mentioned in February 2026 to ascertain the status of the ELC case and for further orders regarding the further hearing of the Succession cause.
