Confirmation of Grant
Introduction and Background
1. Before the Court is the Summons for Confirmation of Grant supported by the Further Affidavit of Edith Nyambura Kironji and Christopher Muremwa Kironji sworn on 27th April 2026 seeking confirmation of the Grant of Letters of Administration Intestate issued in this cause on 7th April 2025.
2. The Court has considered the summons, the supporting affidavit, the schedule of assets forming part of the estate, and the proposed mode of distribution set out therein. The affidavit identifies the beneficiaries and specifies the shares proposed to devolve to each beneficiary.
Analysis and Determination
3. The Grant of Letters of Administration Intestate issued on 7th April 2025 is on record. The statutory period prescribed for confirmation of grant has elapsed.
4. The Court is satisfied that the deceased was survived by Edith Nyambura Kironji, Eric Kimani Kironji, Christopher Muremwa Kironji and Margaret Wanjiku Kironji, Peter Muchiri Muremwa, and Anne Njeri Muremwa who are the persons beneficially entitled to the estate, together with the deceased's siblings in respect of the property specifically earmarked for them in the proposed distribution.
5. The Court is further satisfied that all the assets of the estate have been disclosed and that the beneficiaries entitled thereto have been identified. No protest or objection to the proposed mode of distribution has been lodged.
6. Having considered the material before it, the Court finds no impediment to confirmation of the grant and is satisfied that the proposed distribution should be approved.
Orders
7. Accordingly, the Summons for Confirmation of Grant is hereby allowed.
8. The Grant of Letters of Administration Intestate issued on 7th April 2025 is hereby confirmed.
9. The estate shall devolve in accordance with the mode of distribution set out in paragraph 5 of the Further Affidavit in Support of Summons for Confirmation of Grant sworn on 27th April 2026.
10. A Certificate of Confirmation of Grant shall issue accordingly.
11. Each party shall bear their own costs.
