In the Estate of KING'ANG'I PETER NDAMBIRI

High Court at Milimani High Court · · Robinson Ondieki Kebabe

1. The guidelines governing the grant ad colligenda bona is provided under Section 54 of the Law of Succession Act which provides for limited grants. It states that; “A court may, according to the circumstances of each case, limit a grant of representation which it has jurisdiction to make, in any of the forms described in the Fifth Schedule.” Rule 36 of the Probate and Administration Rules deals with grant ad colligenda bona. It states that; - “Where, owing to special circumstances the urgency of the matter is so great that it would not be possible for the court to make a full grant of representation to the person who would by law be entitled thereto in sufficient time to meet the necessities of the case, any person may apply to the court for the making of a grant of administration ad colligenda bona defunct of the estate of the deceased."
2. I have perused the court file and note that limited letters of administration ad colligenda bona were issued on 25th June, 2025 solely for the collection and getting in and receiving the deceased’s Estate. All the income to the school to be deposited into the known accounts of the school as set out in the limited letters of administration ad colligenda bona of even date.
3. Parties seek for extension of limited letters of administration ad colligenda bona even as the Grant is issued. The Succession cause has been gazetted but the administration of Junior Campus Academy will be brought to halt, in event limited letters are not extended.
4. I hereby extend the limited letters of administration ad colligenda bona issued on 25th June, 2025 solely for the collection and getting in and receiving the deceased’s Estate as set out in that ad colligenda bona.
5. Mention on 29/7/2026. The dates set out prior are hereby vacated.
Delivered in the presence of Purity Ochiel for the applicant and Ms Mwendwa for the 2nd petitioner virtually this 22nd June, 2026.

Hon. R.K. Ondieki,
Judge.
