Ruling
1. Upon the Applicant's Notice of Motion dated 9.12.2025 coming up before me for certification as urgent at the ex parte stage, I have duly considered the same and the affidavit in support thereof and I not that the Applicant has approached this court at the eleventh hour seeking to restrain an event that is scheduled to happen on 10.12.2025. Given that no reason has been adduced for the Applicant's indolence I am not persuaded of the urgency of her application. In any event the application has no substantive prayers other than the one for seeking to stop the survey process all together yet the transmission of the estate of the deceased has to proceed.
2. I do find that this application lacks substratum wherefore I hereby strike it out with no orders as to costs.
