' 1. I have perused the Petition for the Letters of Administration de bonis non adminstratis dated 22nd September 2025 filed by the Petitioner. Zaim Nasser Ahmed is the brother of the deceased administrator, and also the son of the deceased whose estate is the subject of these proceedings. The administrator, Ableey Nasser Ahmed, died on 25th December 2023 before the estate could be fully administered.
2. I note that the other beneficiaries who are entitled to the estate have consented to the application. There is pending litigation, being ELCA No E042 of 2025, where the interest of the estate must be defended.
3. In the circumstances, it is my view, and I find and hold, that the application has merit. Consequently, I order that a grant of letters of administration de bonis non administrates do issue to Zaim Nasser Ahmed forthwith.
4. It is so ordered.
