RULING
I have upon reading the summons dated 19th together with its sworn Affidavit and is thus persuaded that no prejudice shall be occasioned by its ex-parte hearing. I have upon considering this application found favor to allow the same on the following terms;
That the Application dated 20th December 2025 is overtaken by events and the same is accordingly marked with no orders as to costs.
That the scheduled Ruling date of 29th January 2026 is hereby vacated.
That the Succession shall be held in abeyance in view of the consent order dated 14th January 2026 entered in Nakuru COE E162 of 2024 and Nakuru COE Civil Application no E119 of 2024.
The Matter shall be scheduled and mentioned every six (6) months until the Court of Appeal determines the Appeal.
The Applicant shall obtain from the court assistant court number 3 the mention date, to be served together with the directions herein.
It is so ordered
