In the Estate of Ireland Mary Akinyi

High Court at Naivasha High Court · · C.W Githua

I have duly considered the Petition dated 21st August 2026. In the Petition, the Petitioners who are an Aunt and family friend of the deceased, the late Mary Akinyi Ireland seek Limited Grant of Letters of Administration Ad Colligenda Bona in order to enable them secure and preserve the Estate of the deceased who passed away on 15th July 2025 while receiving treatment in the United Kingdom.
From the depositions in the Applicants supporting affidavit and the annextures thereto, it is clear that the late Mary Akinyi Ireland is only survived by four children who are citizens of the United Kingdom who do not live in Kenya.
Her husband, John Andrew Ireland , also a British citizen who was living in Kikopey in Naivasha is also deceased as evidenced by the burial permit and post-mortem form annexed to the Petition marked S & J – 3.
Given the absence of the deceased’s immediate family members in Kenya and given the alleged tragic circumstances in which her husband lost his life, I am satisfied that there is an urgent need to safeguard and preserve the assets in the deceased’s Estate.

Having read and considered the contents of the letters of authorisation and Interim Power of Attorney dated 11th August, 2026 which is executed by the deceased’s four adult children before a Notary Public in the United Kingdom, I find merit in the Petition and the same is hereby allowed as prayed.
Consequently, a Limited Grant of Letters of Administration Ad Colligenda Bona is issued to the Petitioners which shall be limited to gathering and/or collecting, securing and preserving the assets in the deceased’s Estate pending issuance of a full Grant of Administration of the deceased’s Estate.
The Limited Grant to issue accordingly.
It is so ordered.
