I have considered the summons filed by the 2nd Administrator dated 12th April 2024, the affidavit in support thereof and the submissions of Counsel for the 2nd Administrator and for Christine Akinyi Otieno, who concedes the same and I do hereby allow the same pursuant to Section 45, 47 and 82 of the Law of Succession Act and I proceed to make the following orders:-
1. The registration of Duncan Krisse Muga as the proprietor of parcel No. L. R. Kisumu/Kasule/3490 is hereby revoked and the title deed issued to him is hereby cancelled.
2. I order that parcel LR. Kisumu/Kasule/3490 to revert back to the name of the deceased Hesbon Francis Otieno Oluoch forthwith and the Chief Land Registrar Kisumu to effect cancellation and reversion of the title deed to the deceased Hesbon Francis Otieno Oluoch.
3. The registration of Austine Otieno Omedo Ogaye as the proprietor of parcel LR. Kisumu/Kanyadwera/671 is hereby revoked and the new title deed issued to him is hereby cancelled.
4. I hereby order that the title deed to parcel LR Kisumu/Kanyadwera/671 do revert back to the name of the deceased Hesbon Francis Otieno Oluoch and the Chief Land Registrar Kisumu to forthwith effect the revocation, cancellation of title deed issued to Austine Otieno Omedo Ogaye and the reversion of the title deed to the name of Hesbon Francis Otieno Oluoch (deceased).
5. 2nd administrator’s contempt application to be heard on 24.6.2024.
