I have considered the 2^nd Administrator’s notice of motion dated 12^th April 2024 brought under the provisions of Sections 1A, 3, 3A, 5 of the Judicature Act  and Order 61 of the Civil Procedure Rules and I have also considered the affidavit in support thereof sworn by Gilbert Otieno Oluoch on even date and I have also perused the affidavit of service sworn by Kevin Omondi Wadende, a process server on 9^th May 2024 and I do note that the said process server did not effect personal service upon the Chief Land Registrar who is the 2^nd Respondent wherefore I direct that personal service be effected accordingly.
