1. REUBEN MWANGI GITOGO died on 12th June 2025. Before his demise, he had been admitted to the Intensive Care Unit (ICU) at The Nairobi Hospital, Nairobi, intubated and on supportive ventilation, which rendered him incapable of managing his affairs.
2. During his stay at the hospital, the Petitioners/Applicants had made an application to the Honourable Court, HCFMISC/E168/2025 ELIZABETH NGENDO MWANGI - VS - REUBEN MWANGI GITOGO, seeking an order to access the deceased's bank account due to his incapacitation to be able to pay the medical expenses. The case was heard, but before a decision could be made, he passed away the day after the court hearing.
3. The Petitioners are his wife and son, respectively, according to the documents presented in court.
4.The Petition for Special Limited Grant dated 12th June 2025 indicates that the medical bill at Nairobi Hospital is estimated at Kshs. 9.9 million. His body is currently preserved at the Lee Funeral Home.
5. The court makes the following orders in respect of the Petition for Special Limited Grant;
1. THAT a Special Limited Grant is hereby issued to the Petitioners/Applicants, limited only to the purposes set out in this ruling/order.
2. The Limited Grant shall be used to gain access to bank accounts held by the deceased in the following accounts;
i. Account Number 0950294708362 in the name of Reuben Gitogo in Kenya at Equity Bank Kenya Limited, Kayole
ii. Account Number 0650185958852 in the name of Reuben Mwangi in Kenya at Equity Bank Kenya Limited, Kayole
iii. Account Number 0650185958880 in the name of Reuben Mwangi in Kenya at Equity Bank Kenya Limited, Kayole
iv. Account Number 011200274797000007 in the name of Reuben M Gitogo in Kenya at Cooperative Bank Limited, Kayole
v. Account Number 061000029381 in the name of Reuben Gitogo in Kenya at Family Bank, Kayole
vi. Account Number 0092020000270 in the name of Reuben M Gitogo in Kenya at the Rafiki Microfinance Bank Kayole Branch
vii. Account Number 0100004688141 in the name of Reuben M Gitogo Kenya at CFC Stanbic Bank , Kayole
3. THAT the money so accessed shall only be used to settle the medical bills at Nairobi Hospital, whose bill is indicated of approximately Kshs. 9.9 Million, mortuary bills at Lee Funeral Home, and burial expenses.
4. THAT the funds for the settlement of the bills will be disbursed directly by the banks to the two institutions. This order shall be served upon the Bank Managers for compliance.
5. THE Petitioners should not exceed a total withdrawal of Kshs. 12,000,000. Once this limit is reached, no further sums of money may be withdrawn from the said accounts until further orders of this Court are issued.
6. THE Petitioners shall file accounts regarding the funds accessed within 90 days.
7. THAT the matter shall be mentioned on 17th September, 2025 to confirm the filing of accounts and for further directions.
