1. I had already dealt with this matter earlier on. However, Ms. Doris Adera , a child of one of the beneficiaries, late Patrick Adera Choro, remained on the platform and has raised what is recorded above. The Court clarifies as follows: -
a) The Court cannot give legal advise to any party to the proceedings especially on a hotly contested matter like the present one.
b) The administrator had earlier resisted taking steps to finalize the administration of the estate. The Court advised the various beneficiaries to prepare mutations in respect of the properties that required sub-divisions, present them to the Deputy Registrar for execution so as to enable the transmissions to be undertaken.
c) Doris Adera and her siblings ( who are not direct beneficiaries to the current estate) prepared mutations for plot No. 1457 which had been distributed to their father (who is now deceased) and presented the same at the Lands office. That was irregular as the Certificate of Confirmation had distributed that property to Patrick Adera Choro (now deceased) and not to his children.
d) What they were supposed to do, and which is what the Court had earlier on in the morning directed them to do, is to present a Transmission Form together with the Certificate of Confirmation dated 19/9/2025 together with the death certificate of the late Patrick Adera Choro at the Lands Office to enable the property be transmitted to the estate of their father who passed on while these proceedings were pending. After registering the transmission, they are to take out a separate and independent succession cause for the estate of their late father.
e) As regards the proceedings of today, the matter was coming up for mention to receive the accounts by the administrator. Mr. Awuor Advocate for the administrator opted to give an oral report. This was opposed and the Court directed his client to file a written report within 30 days. If the parties are not satisfied, they should make the requisite application for appropriate orders. The foregoing clarifies the matter. Once again, the Court reiterates that it is under no obligation to give any legal advise to any litigant whether represented or not.
2. Mention on 3/11/2026 as earlier on scheduled.
Orders accordingly.
