' RULING
THIS MATTER is an Application filed under a Certificate of Urgency dated 20th August 2025 by Muchiri Stanley Kimaru Advocate, the undated Petition for Letters of Administration Ad Colligenda Bona and the Githoro Location Chief’s Letter dated 15th August 2025 coming up before Hon. Justice Mohochi S.M. AND UPON READING the pleadings as filed, the court notes that, the Application is without any supporting Affidavit, the pecuniary value of the estate is below kshs 800,000/- and as such the magistracy is ably constituted to undertake the succession, therefore directs and Orders the following ;
IT IS HEREBY ORDERED;
1. THAT, this Application is certified as urgent and its hearing Ex-parte is in the interested of justice.
2. THAT, the only asset forming the estate of the deceased is cash in a bank account and the seeking and obtaining a limited grant to access the bank account shall render academic any subsequent succession cause.
3. THAT, a limited grant ad colligenda bono cannot settle and conclude in succession an estate of the deceased.
4. THAT, owing to the disclosed pecuniary value of the estate of the deceased, the Chief Magistrate’s Court at Nakuru is with sufficient jurisdiction to hear and conclude the succession.
5. THAT, the Applicant is directed to forthwith move the Chief Magistrate’s Court at Nakuru for issuance of a Full Grant in settlement of the estate of the deceased.
6. THAT, the Applicant shall duly fill and file forms P&A 80, 5, 11, 12 and 57.
7. THAT, this instant Application is spent and the file shall accordingly be marked as closed.
