1. Before Court is the Summons for Rectification of Grant dated 9th February 2026 seeking rectification of the Certificate of Confirmation of Grant issued on 9th June 2025. The applicant seeks correction of the deceased's name and the name of the second beneficiary appearing in the certificate.

The application is supported by the affidavit of Puneeta Rohitkumar Bhagani who depones that the confirmed grant contains errors in the spelling and presentation of the deceased's name and the second beneficiary's name. It is contended that the deceased's correct name is Rohitkumar Virajlal Bhagani and that the second beneficiary is known as Rashida Gulamali Zavery alias Rashida Rohitkumar Virajlal Bhagani alias Rashila Rohit Bhagani alias Rashila Gulamali Zavery .
3. The Court has perused the supporting documentation annexed to the application, including the will, identification documents and title documents, which demonstrate the use of the names sought to be reflected in the certificate of confirmation of grant.
4. The Court has also considered the consent affidavit sworn by the second beneficiary confirming that she supports the application and has no objection to the rectification sought.
5. Under Rule 43 of the Probate and Administration Rules and section 74 of the Act, the Court may rectify errors in names and descriptions appearing in a grant or certificate issued by the Court where sufficient cause is shown.
6. Having considered the material placed before the Court, I am satisfied that the errors complained of relate to the proper description of the deceased and the beneficiary and do not alter the substance of the grant or the distribution of the estate. The application is therefore merited.
7. Consequently, the Summons for Rectification of Grant dated 9th February 2026 is allowed.
8. The Certificate of Confirmation of Grant issued on 9th June 2025 is hereby rectified as follows:
a. The deceased's name shall appear as ROHITKUMAR VIRAJLAL BHAGANI .
b. The second beneficiary's name shall appear as RASHIDA GULAMALI ZAVERY alias RASHIDA ROHITKUMAR VIRAJLAL BHAGANI alias RASHILA ROHIT BHAGANI alias RASHILA GULAMALI ZAVERY .
9. A rectified Certificate of Confirmation of Grant shall issue accordingly. There shall be no order as to costs.
