1. I have perused the Petition for Special Limited Grant dated 28th October 2024 brought under a certificate of urgency. I have also read the affidavit in support of the petition dated sworn on the said date as well as the annextures attached thereto.
2. I note that two suits are pending before the Environment and Land Court that require urgent attention on the part of the deceased person's estate. In the circumstances, and as the beneficiaries have agreed as evidenced by the consent filed herein, I allow the Petition and order that special limited grant be issued to Swaleh Hussein Saleh to prosecute Mombasa ELC Constitutional Petition No. 44 of 2020 and Mombasa ELC Civil Application No 58 of 2015.
3. I order that the Petition for full grant be filed within 90 days, failing which the orders issued herein will lapse.
4. As this is a non-contentious succession matter, I make no orders as costs.
