I have read the applicants' application dated 23 July 2025 filed under a certficate of urgency of even date. I am satisfied that the application is urgent. I direct that the application be served for mention before the presiding judge on 4 August 2025 for such directions orders that the judge may deem appropriate to grant. In the meantime, conservatory orders are issued pending such directions or orders as follows:
1. The decision and/or resolution of the 1st and 2ⁿᵈ Respondents declaring the 1st and 2ⁿᵈ Petitioners' seats as vacant is hereby suspended.
2. The 3rd Respondent, either by itself, its agents, officers or any person acting under its instructions, is hereby restrained from publishing,
advertising, gazetting or in any other manner declaring the seat of Member of County Assembly for Mboghoni and Rong'e Wards as vacant.
Orders accordingly.
