Hawo Abdi Gonjobe VS Hon. Mohamed Garama Randu, Senior Resident Kadhi AND Abduba Guyo Wada

High Court at Milimani High Court · · Jairus Ngaah

I have considered the applicant's application dated 12 April 2024 filed under a certificate of urgency of even date. I am satisfied that the application is urgent and it is so certified. Leave is granted to the applicant to file the motion for judicial review orders in terms of prayers 2(a), (b) and (c) of the chamber summons. It appears from the proceedings in which the impugned order was made that the initial order for production of the child in court was made way back in November last year. For this reason, the prayer for leave to operate as stay is declined.

The main motion shall be filed and served within 7 days of the date of this ruling. The respondent and interested party shall file and serve their response to the motion within 7 days of the date of service of the applicant's motion. It shall be mentioned on 8 May 2024 for purposes of taking directions on the manner of its disposal. It is so ordered.
