By a chamber summons dated 23 rd March 2026, the exparte applicant seeks leave to file a judicial review application seeking an order of mandamus to compel the respondents to pay to the exparte applicant herein through their advocates a sum of Kshs 2,670,556, being the decretal sum, costs and interest awarded in KAKAMEGA CMCC No.50 of 2020, Harun Anunda Aura versus The AG & 3 Others. The applicant also seeks costs of the application.
The application is premised on an affidavit by the exparte applicant and grounds listed on the face thereof.
The gravamen of the application is that the exparte applicant having succeeded in his suit before KAKAMEGA CMCC NO.50 OF 2020, did serve the Attorney General’s office with a certificate of order and certificate of costs all totaling Kshs 2,670,556. That the respondents have refused to pay as is required.
I have considered the application, the affidavit in support together with all the annextures. I am satisfied that the exparte applicant has made a case for grant of leave as sought and the same is accordingly granted.
The substantive notice of motion be filed within 21 days from the date hereof.
Costs shall be in the cause.
