1. Due to the time taken by the Court while considering the case of the BOARD OF DIRECTORS (GATOTO PRIMARY SCHOOL) AND THE BOARD OF MANAGEMENT, GATOTO COMMUNITY PRIMARY SCHOOL (NON-PROFIT COMMUNITY-BASED APBET PRIMARY SCHOOL) V PETER WABWOBA MAKALI (ASSISTANT COUNTY COMMISSIONER AND MARY KIMEU, SUB COUNTY EDUCATION OFFICER, EMBAKASI AND 5 Others, the ruling in respect of the prayer for conservatory relief is not ready. The ruling will now be delivered on 23rd July 2026 at 11 am.

Pending delivery of the ruling as aforesaid, the sale slated for 21st July 2026 is hereby stayed, with the consequence that the 1st Respondent, and or its servants, and or agents, is hereby restrained from selling the 1st Petitioner’s property known as LR No 2327/252 situated at Karen, Nairobi, until the said ruling is delivered.
3. Orders accordingly.
