HANNAH WANJIRU NJERI VS The Republic

High Court at Kiambu High Court · · Bahati Mwamuye MBS

1. The Applicant, Hannah Wanjiru Njeri, was charged, convicted, and sentenced with respect to the offence of Child Negligence on 10/07/2025. She was sentenced to serve 2 years imprisonment.

2. She has moved to Court vide a Notice of Motion Application dated 15/12/2026 which is supported by her Affidavit of even date.

3. The Application seeks that the Applicant serve the remainder of her sentence non-custodially and pursuant to the provisions of Section 3(b) of the Community Service Order Act.

4. The Applicant avers that as at the date of filing she had 11 months left of her sentence. She also pleads that she is remorseful, rehabilitated and eager to resume her family life as a mother of two children of tender years.

5. The Application is unopposed.

6. Having considered the Application, the oral arguments by the Applicant at today’s hearing, and the lack of opposition by the Prosecution; I hereby find and hold that the Applicant’s time already served is deemed to be sufficient and not-requiring probationary terms on account of the very short time that the same would apply for.

7. In the result, the Applicant’s sentence is now fully served, and the Applicant is to be immediately set at liberty unless otherwise lawfully detained, with the best wishes of the Court for a happy and prosperous life without any further conflict with the law.

8. Orders Accordingly. File Closed Accordingly.

DATED, SIGNED, AND DELIVERED AT KIAMBU ON THIS 11 TH DAY OF MAY 2026.
