The Company in this matter ordered and was supplied metal doors and grills from the Petitioner amounting to KES. 766,505.80 between 1st January 2018 and 1st November 2018. Despite various demand and notices to sue, the Company failed to settle the debt causing the Petitioner to issue and serve upon it a demand under the Insolvency Act. Upon expiry of the statutory period, the Petitioner filed the Petition dated 22nd November 2021 seeking to liquidate the Company.
The Petitioner was served and duly advertised on 31.01.2022. It has not been opposed. I am therefore satisfied that on the uncontested evidence that the Company is indebted to the Petitioner and it is unable to pay its debts.
I therefore orders as follows:
1. A Liquidation Order be and is hereby issued liquidating the Company.
2. The Official Receiver is hereby appointed as provisional liquidator.
3. Costs of the petition shall be in the liquidation.
