I have considered Mr Michuki’s application that we do not give judgment date at this point.

I note that there is no order of stay of proceedings from the Court of Appeal. The record shows that the Plaintiff was given 21 (Twenty One) days from 2^nd April 2025 to file written submissions. The Plaintiff seems to have deliberately decided not to comply with that order.

I see no valid reason to keep this matter pending. The Plaintiff to file and serve written submissions by close of business on 23^rd May 2025. In default, the Plaintiff shall be deemed not to have filed any submissions. Judgment will be delivered on 14^th July 2025 at 10:00am.
