1. I have carefully perused the application dated 28.5.2025.
2. I noted that this suit was filed in the year 2003 .
3. As at the time of filing of the suit there were no special Land Courts .
4. Article 162 (2) (b)of the Constitution of Kenya 2012 provides for establishment of Land & Environment courts and the same have since been established In the Counties and the magistrate courts.
5. Article 165 (5) (b) of the Constitution bars the High Court from usurping the powers of the Land courts .
6. This court thus lacks Jurisdiction to hear and determine this case and i proceed to transfer it to the KIsii Environment and Land Court for hearing and determination.
7. Mention on 24.6.25 before the Deputy Registrar Kisii Land and Environment court for directions on placement before the Judge
