GLOBAL EXHIBITIONS INCORPORATED LIMITED VS County Government of Vihiga

I have looked at the Ex parte Applicant's Chamber Summons application dated 18th April 2024 and filed on 28th April 2024 and the Supporting Affidavit of Edwin Masivo that was sworn on 18th April 2024 and and the enclosures therein and noted that the Ex parte Applicant filed a similar application in HCJR No E002 of 2024 wherein I declined to grant the orders it had sought as the application for leave to institute proceedings of mandamus against the Respondents herein had been filed in a substantive file. It is not clear why the Ex parte Applicant has filed yet another application in a new file where the substantive application ought to be heard and determined. I am not persuaded that I should certify this matter as urgent and/or grant any substantive order ex parte. Accordingly, I hereby dismiss the present application and direct that the Ex parte Applicant moves the court in a proper manner in the proper file. It is hereby directed that the file herein be and is hereby closed forthwith. Orders accordingly.
