In the application dated 20.04.2023, the applicants who have been condemned to pay costs following the striking out the suit seek stay pending appeal. I have heard the arguments by the parties and I am inclined to allow the application on the terms that the applicants; Anne Wanjiru Gitere and Samuel Mburu Gitere shall deposit the decretal sums in court within 21 days from the date hereof. In default the of such compliance, the stay shall stand discharged.
I decline to intervene any other proceedings as this suit is complete and has been determined. The order can be sought in the other suit pending proceedings. Orders accordingly.
