RULING
1. The Applicant herein is the advocate of the Respondent in the proceeding known as ELC Case No.70 of 2013 which is still on going.
2. Due to strained relationship between the Applicant and the Respondent, a Bill of Costs dated 17.12.2013 was filed.
3. The Taxing Officer in determination of the Bill of Costs dated 17.12.2012 did acknowledge not having the mother file before her to facilitate the taxation.
4. It is clear in the mind of the Court that the relationship between the Applicant and the Respondent is still on going as no Notice of Change or an order for leave to cease acting has been issued.
5. In essence therefore the Bill of Costs dated 17.12.2013 was pre-mature.
6. By extension, the Taxing Officer did err by making final Orders as regards the said Bill of Costs dated 17.12.2013 before the relationship between the Applicant and the Respondent was terminated.
7. In conclusion therefore, the Ruling pronounced on the 18.07.2025 is hereby set-aside.
8. There will be no orders on this Reference.
