I have had occasion to peruse and consider the Petition and the Notice of Motion filed under a certificate of urgency. On the material before me, the urgency in the matter is discernable.
My attention has been drawn to the existence of 7 petitions of a similar nature filed at the High Court in Nairobi and one transferred to Nairobi from the High court sitting at Kiambu. Within this background, proceeding with the prosecution of the petition herein in this court creates a real possibility of conflicting orders by a court of concurrent jurisdiction an eventuality that would visit embarrssment on the court. It is desirable that all the issues related to the subject be handled together by one judge or if it becomes desirable and upon application by one bench.
Suffice it to add that notably all the Respondents and the Interested Party are domiciled at Nairobi and though the High Court has unlimited jurisdiction both peuniary and territorial, administratively, the most convinient place to have this Petition heard and determined would of necessity be the Constitutional and Human Rights Division at Nairobi.
In view of the foregoing, i direct that the Petition herein be placed before the Presiding Judge, Constitutional and Human Rights Division, Milimani for directions.
