1. The application dated 24th June, 2023 seeks extension of time to file a memorandum of appeal against the judgment of Hon Caroline Ndumia delivered on 26th May, 2023 which was dated 20th April, 2023.
2. It is supported by the affidavit of Fredrick Omondi Okongo dated 24th June, 2023. It is clear from the affidavit of service dated 18th March, 2024 that the application was served on the respondent by way of email on 25th October, 2023. The application has to date not been responded to.
3. In the circumstances and having considered the affidavit and the evidence filed by the applicant, the application dated 24th June, 2023 is allowed as prayed. Consequently, the record of appeal shall be filed and served in the next 14 days for further directions on the appeal on 23rd May, 2024. Notice to issue.
