FRANCIS NJIHIA CHEGE AND JACKLINE NYOKABI NJOROGE VS KENYA WOMEN MICROFINANCE BANK AND PHILIP M. KAMUYA T/A CRATER VIEW AUCTIONEERS

High Court at Voi High Court · · Jairus Ngaah

I have considered the applicant's application dated 7 July 2025, filed under a certificate of urgency of the same date. In exercise of its appellate jurisdiction, this Honorable Court does not have jurisdiction to issue an injunction pending appeal. In appropriate cases, it can only stay execution pending appeal. In the circumstances, I am not satisfied that the application is urgent as it may not be viable in the first place. Accordingly, I direct that the application be served for directions once the presiding judge, High Court Voi, resumes from leave. The matter shall therefore be mentioned on 16 September 2025. It is so ordered.
