FOOTBALL KENYA FEDERATION VS Sports Disputes Tribunal AND MILTON NYAKUNDI ORIKU

High Court at Milimani High Court · · Jairus Ngaah

I have read the applicant's application dated 31 January 2024 filed under a certificate of urgency of even date. I note a similar application, no. 21 of 2024, was filed by a different firm of advocates which have since withdrawn the application. In that previous application, the court did not find the application urgent and directed that the main motion be filed and served. It was to come for directions on 16 April 2024. Except for the different firm of advocates, this application is on all fours with the withdrawn application. I find no reason why I should give directions different from those I issued in application no. 21 of  2024. Accordingly, I find no reason or reasons to certify this matter urgent. The applicants are, however, granted leave to file a substantive motion for judicial review reliefs for which leave is sought in prayers 2 and 3 of the chamber summons. The prayer for leave to operate as stay is declined. The substantive motion to be filed and served within 14 days of the date of this ruling. The respondent and interested parties to file and serve their response within 14 days of the date of service of the substantive motion. Mention of the suit will be on 16 April 2024 for purposes of taking directions on the manner of its disposal.

I must mention that i have had to deal with this application despite the fact that I am on leave because it is apparent on the face of the application that it revolves around my judgment in application no. E005 of 2022. I have had to step in, if not for anything else, to avoid the possibility of different judges issuing conflicting orders over the same issues.  Orders accordingly.
