Felix Wambande Oronje VS FESTUS ORONJE AND CATHERINE WANDALO ORONJE AND 5 Others

Environment and Land Court at Kakamega Environment and Land Court · · Dalmas Ohungo

The issue that arises for determination is whether this case should be transferred to Mumias Law Courts for hearing and determination. I have considered the parties submissions. It is apparent that the suit property is located within the local limits of Mumias Law Courts and its value is within the pecuniary jurisdiction of that court. The plaintiff's concerns as to whether he will get a fair hearing before Mumias Law Courts is no valid reason to file the case before this court. The plaintiff has a right of appeal against any decision made by Mumias Law Courts. I do not see any valid reason why the case cannot be heard and determined by Mumias Law Courts. I hereby transfer this case to Mumias Law Courts for hearing and determination. Mention on 12th June 2024 before Mumias Law Courts for further directions.
