I have perused the chamber summons dated 05th March 2025 filed under certificate of urgency. I observe that the decision which the applicants seek to have impugned was rendered vide letter dated 03/02/2025 and communicated to the applicants the same day which the applicants wrote a letter of complaint dated 04/02/2025. However, the applicants have waited until the eve of the scheduled election for them to approach the court to challenge the decision that dismissed their appeal. There is absolutely no reason advanced for the delay in the filing of these proceedings.
I find no urgency involved. I decline to certify the matter as urgent. I direct the applicant to serve the Respondents and all interested or affected parties for interpartes directions on 10/03/2025.
I further decline to grant any stay the scheduled elections which are due on 06/03/2025 as the Respondents and interested parties deserve the opportunity to be heard on the challenge to the decision of 03/02/2025 before halting the scheduled elections. Registry to notify the applicant’s counsel forthwith. I so order.
