RULING

  1. The outstanding amount arising for the Decree issued in 2018 is Kshs.432,000.
  2. The outstanding will be liquidated by way of monthly instalments of not less than Kshs.75,000 payable on or before the 6th day of every month with 1st instalment being due on 6th April, 2025.
  3. On the issue of auctioneers costs, the debtor is at liberty to discuss the same with the auctioneer and in event no agreement is reached, the auctioneer is at liberty to tax.
  4. In the event of any default in the payment of outstanding decretal sum from the Decree of 2018, the judgment holder is at liberty to execute.
  5. Each party will bear its own costs as regards the application dated 3rd February, 2025.
  6. This file is closed unless any party applies.
