'I have heard Learned Counsel for the applicant, herein on the application dated 10.9.25 and the Children officer’s report filed herein this morning . Miss Nyaata who intended to act for the respondent was present in the morning when directions for 3.00pm were given in this matter. It is now 3.32 PM Nirthe4r counsel not the respondent are present. I have also considered the fact that the subject is a child of tender years (i.e a 2 year old) and that the applicant is a student at Maseno University studying Bachelor of Education. In the best interest of the child and the applicant’s education I will grant prayers 2 and 3 unconditionally in the interim pending interpartes hearing and determination of the application. Directions on the application on 21.10.25.
