Ruling
Upon Reading the Chamber Summons dated 27th January 2026 under Certificate of Urgency and supported by the Sworn Affidavit of Joshua Musembi Ndolo Advocate, the court hereby directs and Orders as follows;
1. No Prejudice shall be occasioned upon the Respondent and the Application is certified as urgent warranting being heard and disposed of ex-parte with its service being dispensed with in the first instance.
2. The Applicant is hereby granted leave to amend its counter claim dated 28th August 2023. And that the draft amended counterclaim dated 26th January 2026 is hereby deemed as duly filed.
3. The amended counterclaim shall be served upon the Respondent.
4. Inter Parte mention for further directions shall be on the 23rd February 2026
