' Ruling.
1. Upon the Appellant''s Notice of motion dated 27th October 2025 coming up for directions at the ex parte stage for certification of the same as urgent and for consideration of it''s prayer for issuance of an interim order of stay of execution, I have duly considered the same, the affidavit in support thereof sworn by Dancan Otieno Njoga on even date and the enclosures attached thereto and I note that the respondent has already issued a proclamation wherefore execution is imminent. Urgency has thus been demonstrated. I therefore make the following orders:-
i) This application is certified a urgent.
ii) The same be served within 2 days and a response be filed within 6 days from the date hereof.
iii) Inter partes hearing is scheduled on 4th November 2025.
iv) An order of stay of execution of the decree herein by Dominion Yards Auctioneers is hereby granted until 4th November 2025.
