FANICE NYOKABI AMBISI VS The Republic

High Court at Milimani High Court · · Alexander Muasya Muteti

The applicant was charged with the offence of stealing Contrary to Section 278 of the Penal Code. She was sentenced to serve two-year prison term.

The applicant has so far served 10 months and is left with 6 months to serve. She regrets her actions and has pleaded to be considered for a non-custodial sentence.

The court has considered her passionate plea for mercy and is inclined to review the sentence. The applicant is however warned that upon benefiting from orders of this court granting her release from prison, she must remain a law abiding citizen and desist from engaging in Criminal Acts.

She has told this court that she stole household items from her employer whom she served as a househelp.

It is the view of this court that the applicant has learnt a useful lesson from her stint in prison.

The court in exercise of the powers conferred upon it under Section 364 of the Criminal Procedure Code as read together with Article 165 of the Constitution has substituted the prison term of 2 years with the period of 10 months already served. The accused shall be released forthwith from prison custody.

It is so ordered.
