I have read the letter dated 31 May 2023 by counsel for the applicant in the application before court dated 29 May 2023. The letter is addressed to the Deputy Registrar and it is basically a complaint by the applicant's counsel, apparently on behalf of his client, that although the application was filed on 29 May 2023, it has not been attended to to date.
Contrary to those allegations, the Case Tracking System shows that the application was filed on 30 May 2023. Even then, so I am informed by Mr. Beja my court assistant, the application could not appear on the CTS dashboard as an application under a certificate of urgency because the applicant's counsel underpaid fees by Kshs. 1500. It is only after payment of this fees today the 31 May 2023 that the application was prompted to appear as an application filed under a certificate of urgency.
The picture presented in the applicant's counsel's letter that the court has delayed in issuing directions on the application is thus inconsistent with the facts.
Be that as it may, I have considered the application dated 29 May 2023 and a certificate of urgency of even date under which it is filed. I am satisfied that the application is urgent and it is so certified. I direct that the same be served for inter parte hearing on 12 June 2023. It is so ordered.
