High Court at Milimani High Court · · Visram Aleem Alnashir

1. I have considered the debtors petition dated 29 September 2020. I note that the same is not opposed.

2. I have also considered the petitioner’s Statement of Affairs dated 29 September 2020 and the petitioner’s affidavit in support of the same sworn on even date setting out the reasons why the petitioner has been and remains unable to meet her financial obligations.

3. I have considered Exhibit ETM 1A and ETM 1b which I note have been annexed in support of the Petition. The said Exhibits contain various letters from a hospital in respect of the petitioner medical status; and various receipts of sums paid by the petitioner as evidence of the financial demands on the Petitioner; and demonstrating her inability to meet the same.

4. I take further note that the petitioner has lost her job and her medical condition is such that she cannot presently, and is unlikely to work again in the future. At present she is supported wholly by family.

5. Based on the reasons above, I find it appropriate to make and hereby make a bankruptcy order in respect of the petitioner. The Petitioner is accordingly adjudged bankrupt.

6. The Official Receiver is appointed as trustee of the property of Petitioner in the interim.

7. The file is marked as closed
