I have read the applicant's application dated 11 September 2026 filed under a certificate of urgency of even date. From the applicant's own pleadings, it is apparent that there is another case being ELC E003 of 2023 in which parties in this suit are not only the same parties in that suit but also the dispute revolves around ownership and occupation of a certain parcel of land which forms the background of the instant petition. In these circumstances, I am hesitant to certify the instant application urgent. I direct the application and the petition be seved for directions on 30 September 2026.
