This court having perused and heard counsel for the EACC and the Respondent who acts in person records and adopts the settlement agreement reached between them on the 4th day of September 2024 as follows:-
1. That Teresa Chepchumba Morogo has admitted liability for the sums received amounting to the total sum of Kenya Shillings six hundred and sixty thousand eight hundred and twenty five and sixty-six cents (Kshs.660,825.60)
2. That Teresa Chepchumba Morogo shall make payment of the principal sum of Kshs. Sixty Thousand, Eight Hundred and Twenty Five and Sixty Six cents (Kshs.660,825.66) plus interests calculated at Kes Sixty Nine Thousand Three Hundred and Eighty Six and Seventy cents (Kshs.69,386/70) with effect from 6th May 2024, for a period of 8 months until payment in full.
3. The interest payable in clause 2 above shall not accrue as long as full payment is made within 8 months with effect from 6th May 2024.
PAYMENT SCHEDULE
4. Teresa Chepchumba Morogo has agreed to pay and the commission had accepted to receive payment of the principal sum together with interest not later than 6th day of January 2025.
5. Part of the principal sum of Kshs.660,825.66 amounting to Kshs.200,000 and Kshs.300,000 that has already been paid. The balance of Kshs.160,825.66 and interest of Kshs.69,386/70 shall be paid on or before the 6th day of January 2025.
6. In default of payment in terms of Clause 5 above, an interest rate of 12% p.a will apply to the outstanding amount from that indicated above with effect from 1st May 2023 to the date of payment in full and the commission shall be at liberty to execute for sums outstanding.
7. Further mention on 7th January 2025 to confirm compliance with a view to closing this file.
