I have gone through the originating motion dated 4/3/2026 brought under certificate of urgency. I have also read the supporting affidavit sworn by Charity Muniu, the applicant’s investigator.
The applicant claims that the 1 st respondent who is an employee of the County Government of Kiambu has with his wife the 2 nd respondent, amassed and accumulated wealth between the period 2015 to 2025 which is disproportionate to their known sources of income. It is also deponed that the 1 st respondent has received a cumulative sum of Ksh. 490,874,607/95 during the period under investigations while his cumulative salary for the same period is Ksh. 1,200,000/=.
I am convinced that the applicant has established a prima facie case which deserves the orders of preservation as prayed in the said originating motion. Of more probative value is the averments that the 1 st respondent has failed to give information which would enable the applicant conduct a fair inquiry as to why and for what purpose he received the said amount. Further, the County Government of Kiambu has also failed to provide the necessary information.
Based on the above, the originating motion is found to be merited. Consequently, the same is allowed in terms of prayers 2 and 3. There shall be no orders as to costs.
Dated signed and delivered at Nairobi this 4 th day of March 2026.
