By application dated 23/5/2025, the applicant seeks to freeze or preserve funds in account numbers 2044894192 held at ABSA Bank in the name of the respondent and 1273268415 held at KCB in the name of the respondent too. The application is supported by an affivit sworn by Anderson Weru Macharia an investigator working with the applicant.
The deponent has stated that the funds the applicant seeks to preserve were transferred to the said account by the National Treasury under a program called Program for Rural Outreach for Financial Innovations and Technologies. This programme was launched on 22/12/2010 with the objective of increasing income of a target group as a result of improved production, productivity and marketing in the various rural enterprises sections.
The applicant has investigated bank account number 01141419559400 held at KCB which was used to maintain the funds for the programme. The investigations have shown that between 27/7/2020 and 29/9/2022 the respondent was paid Kshs. 50,610,636.00 by the programme. It is also claimed that a director of the respondents is a proxy of the project’s accountant who is an employee of the National Treasury. Despite payment of the aforesaid amount, the respondent did not do any work for the project thus the money is in the verge of being lost. The applicant states further that trail of the money received traces the money to the account it wishes to preserve or freeze.
Having gone through the affidavit and documents annexed to the same, I am convinced that the application is merited. The granting of the orders will ensure that any recovery proceedings the applicant may institute will not be rendered nugatory.
In the circumstances I grant the application in terms of prayers 2(i) and (ii) and 3 of the said application. This file is closed.
Dated, signed and delivered at Nairobi this 30 th day of May 2025.
