RULING
This Court has perused and considered the Originating Motion dated 13.7.2026 together with the supporting affidavit and the certificate of urgency. In the supporting affidavit, the deponent states that preliminary investigations conducted by EACC so far reveal that the 2nd Respondent has accumulated immense assets that are disproportionate to his known legitimate sources of income and having received millions of shillings in cash, Mpesa and bank deposits that are reasonable suspected to have been acquired as a result of corrupt conduct. Further preliminary investigations have established that the 2nd Respondent received millions in cash , Mpesa and bank deposits that are reasonably suspected to have been acquired as a result of corrupt conduct including funds in an account held jointly with the 3rd Respondent . Preliminary investigations have established that the 2nd Respondent is in the process of purchasing a housing unit from the 1st Respondent and that he has paid Kshs. 500,000/-. This sum was deposited in the bank account of the 1st Respondent held at Equity Bank account no. 1410284...620. The deponent states that the said sum paid into the 1st Respondent's bank account is believed to be proceeds of corrupt conduct and that, pending the completion of investigations, there is reasonable apprehension that the Respondents may withdraw or transfer the funds to the detriment of the public.
The applicant has urged this court to make an order prohibiting the withdrawal, transfer, disposal, or any other dealing with the Kshs. 500,000/- in the 1st Respondent's Account and Kshs. 1,749,512.47/= held in a joint account between the 2nd and 3rd Respondents , account no. 0610184872978, in the names of the 2nd and 3rd Respondents, at Equity Bank.
In the interest of justice and having been satisfied that the Applicant is deserving of the orders sought herein, I hereby allow the application in terms of prayers 2, 3 & 4 of the application dated 13.7.2026.
I make no orders as to costs.
