Ethics and Anti-Corruption Commission VS CHIGWELL HOLDINGS LIMITED

High Court at Milimani High Court · · Benjamin Mwikya Musyoki

The application before me is dated 19/6/2026. It seeks to prohibit the respondent from transferring, disposing or dealing with Ksh 24,693,000/= in bank account number 0107498001 held at Diamond Trust Bank for a period of six months.

The application is brought under Section 56 of the Anti-Corruption and Economic Crimes Act. It is supported by affidavit of Catherine Ngari sworn on the same date. Catherine avers that she is an investigator with EACC and a member of a team tasked to undertake an inquiry into an allegation of conflict of interest, abuse of office, bribery and possession of unexplained wealth against one Patrick Analoh Akivanga a public officer employed by the Nairobi City County Government.

A search at Patrick’s residence recovered Kshs. 65 million which was reasonably believed to have been acquired as a result of corrupt conduct. The said Patrick is in the process of purchasing a housing unit from the respondent at Tsavo Court Phenom Park IV Langata at a cost of Ksh. 38,500,000/=. As part of the purchase price, Patrick Analoh Akivanga paid Kshs. 24,693,000/= between 6/5/2005 and 24/4/2026 in form of cash deposits, electronic funds transfer and RTGS. The property has not yet been transferred to Patrick but the respondent is still holding the money as the account currently has Kshs. 91,281,300/77.

I have considered the application and the annextures to the supporting affidavit. I note that the said Patrick Analoh Akivanga is under active investigations. There are other applications (Misc. E024 of 2026 and Misc. E022 of 2026) where orders freezing Patrick’s accounts and other assets have been given. The applicant has established that the respondent is holding money which found their way into its accounts most likely from the suspect.

I am satisfied that the applicant has made its case against Patrick Analoh Akivanga save to observe that the said Patrick would have been a necessary party to this application as the money is still being held on his account.

Having stated the above, I note that no allegations were made against the respondent. There is also no evidence that the respondent was aware that the source of the purchase price was a corrupt conduct. In this regard, I must make it clear that the orders of prohibition which I intend to grant shall be restricted to amount up to Kshs. 24,693,000/= claimed by the applicant.

Consequently, I proceed to issue the following orders: -

a) The respondent is restrained and prohibited from either through itself or through its agents, servants or any other person from withdrawing, transferring, disposing or in any other way dealing with Kshs. 24,693,000/= in bank account number 0107498001 in the name of Chigwell Holdings Limited.

b) For clarity, the above prohibition shall be limited to a maximum of the said Kshs. 24,693,000/= such that the appellant is at liberty to deal with any amount above the aforesaid maximum.

c) This order shall be in force for six (6) months.

d) There shall be no orders as to costs.

e) This file is closed.

Dated, signed and delivered at Nairobi this 22 nd day of June 2026.
