I have read the applicant's application dated 21 May 2026 filed under a certificate of urgency of even date. I am not satisfied that the application is urgent. Nonetheless, the Applicant is granted leave to apply for orders of judicial review of:
(a) An Order of Mandamus be issued compelling the Respondents jointly and severally to settle the outstanding decretal sum and accrued interest owing to the Applicant following the issuance of the Decree of this Honorable Court dated 9th June 2020.
(b) An Order of Mandamus be issued compelling the Respondents jointly and severally to settle the Certificate of Order For Costs Against the Government dated 30th January 2025.
(c) An Order of Mandamus be issued compelling the Respondents jointly and severally to settle the outstanding Certificates of Costs on Taxation issued in Mombasa Civil Application No. E014 of 2021, Mombasa Civil Application No. E053 of 2021 and Mombasa Civil Appeal No. E003 of 2020 issued in favor of the ex parte Applicant.
The substantive motion shall be filed and served within 14 days of the date of this order. The respondents are directed to file and serve their response to the application within 14 days of the date of service of the application. Directions on the hearing of the application shall be given on 8 July 2026. It is so ordered.
