RULING
- The application dated 27th November, 2024 is seeking for this Court to relook at the lower court file known as Eldoret Chief Magistrate Court ELC case No.21 of 2022.
- The Applicant is clearly aggrieved by the directions and/or orders issued by the Trial Court during the pendency of the said proceedings.
- This Court has considered the application and submissions of the Counsel for the Applicant and it is of the considered view that it does not have jurisdiction to either review, set-aside and/or interfere with the directions and/or orders of the Lower Court through its supervisory powers.
- The Applicant can either seek review from the Lower Court or file an Appeal before this court.
- This Court cannot direct the Trial Court on how the proceedings therein should be handled as this would amount to interference of judicial powers.
- Consequently, the application dated 27th November, 2024 is dismissed with costs.
DATED, SIGNED & DELIVERED Virtually in Eldoret ELC Court on 3rd April, 2025.
