1. I have considered the application dated 5th December, 2024 under certificate of urgency.
2. I do not certify it urgent.
3. I observe that the matter is a purely land case for eviction from a parcel of land, falling within the jurisdiction of the Environment and land Court. It was however heard and determined by the High Court during the transitional period noting that the suit was filed in 2004 prior to the promulgation of the 2010 Constitution and the establishment of the Environment and Land Court.
4. Accordingly, i hereby transfer this matter to the Environment and Land Court at Kisumu for further necessary action.
